This session will explore how disability can interact with disciplinary processes and the key considerations for employers when managing cases where conduct or performance issues may be affected by an underlying health condition. We will look at the legal framework under the Equality Act 2010, including when disability is engaged, how to assess the need for reasonable adjustments, and how disability may operate as a defence in disciplinary situations. The session will also provide practical guidance, case law insights, and strategies to help organisations navigate complex scenarios where capability, conduct and disability intersect.
